1673 | Will Records of Knox County, Ohio. Book A, pp 120-125 The last will and testament of Peter Baker, deceased The State of Ohio Knox County. Be it remembered that heretofor to wit at a Special Court of Common Pleas holden in the Town of Mount Vernon within and for the said County of Knox on the 28th day of August, A.D, 1830 before the Hon James M Gibing, Anthony Banning & Abner Ayres, Esq, associate Judges of the Court of Common Pleas for the County of Knox, The Last will & settlement of Peter Baker, Deceased, being brought before the court was proved by the oaths of John Greer & Solomon Robinson who upon their solemn affirmation say that said will was signed by said deceased in their presence & that he published & declared the same to be his last will & testament in the presence & hearing of said John Greer & Solomon Robinson, & that they at his request signed the said will and witnessed that the Testator at the time of executing the said will was of full age & of sound mind & memory & not under any restraint. And it appearing to the satisfaction of the court that said will was duly executed and that said Testator was competent at the time thereof as required by the statutes to execute the same. It is there upon ordered by the Court that the Clerk record said will & the proof above taken. William Robinson, Executor of the above personal estate, came personally into open court and was qualified as such according to law, probate is therefore granted of said will & William Liedick, Solomon Robison [sic], & Daniel Sapp appointed appraisers & it is further ordered that letters testamentary issue to said William Robison, which ___ and as follows, to wit: In the name of God, Amen. I, Peter Baker, of the County of Knox & State of Ohio, being weak in body but of sound mind & memory, thanks be to Almighty God for the same, do make & publish this my last will and testament as follows that is to say: First, it is my will that my funeral expenses and all my just debts be fully paid. Second I give & bequeath to my beloved wife Susannah Baker in lieu of her Dower, the plantation on which we now live or reside situated in range ten, township seven section seven & part seven SW qtr & part of the NW qtr in section fourteen in the range & township aforesaid containing two hundred and twenty acres, more or less, during her natural life or so long as she continues to be my widow, but if she should marry again, then & in that case, she is to have the one-third of my real estate set off to her and no more; & one horse, two cows, six sheep, five hogs, one saddle & bridle, one bed & bedding, dresser & dresser ware, & one hundred dollars worth of household furniture & other items not disposed of by this my will. I will & bequeath to my son William Baker one bay horse colt, three years old, & saddle & bridle & eighty dollars in cash, & an equal part in all my real & personal estate not otherwise disposed of by this will. I will & bequeath to my daughter Hannah Baker eighty dollars in cash & two cows, two beds & bedding & four sheep, & the farther sum of ten dollars to purchase dresser ware etc, & also an equal part in all my real & personal estate not otherwise disposed of by this my will. I will & bequeath to my daughter Susannah Baker, now Susannah McMillen, & to my son-in-law Robert McMillen, the sum of thirty-six dollars 87 cents & also discharge the said Susannah & Robert from a book account of forty-three dollars and thirteen cents that I gave to them. They are to have an equal twelfth part also in all my real & personal estate not otherwise disposed of by this my will. I further will & bequeath to my daughter Julian Baker, now Julian Thatcher, & Isaac Thatcher, my son-in-law, the sum of forty-two dollars and 37 _ cents, & also to be discharged and also discharged from the sum of thirty-seven dollars, 62 _ cents of a book account that I gave to them & to have an equal twelfth part in all my real & personal estate not otherwise disposed of by this my will. I will & bequest to my daughter Polly Baker, now Polly Roof, and to my son-in-law, Jacob Roof, the sum of nine dollars 34 _ cents, & also discharge them, the said Polly & Jacob Roof, a book account of $70.65 _; they are to have an equal twelfth part of all my real & personal estate not otherwise disposed of by this my will. I will & bequeath to my daughter Elizabeth Baker, now Elizabeth Hauger, & my son-in-law Joseph Hauger, an equal twelfth part of all my real & personal estate not otherwise disposed of by this my will, & I also discharge them from a book account of $80.00 that I gave to them. I further will & bequeath to my daughter Caty (Katherine) Baker, now Caty Winteringer, and my son-in-law Thomas Winteringer, one twelfth part of all my real & personal estate not otherwise disposed of by this my will, & I also discharge them from a book account of $80.00 that I gave to them. To my other sons, that is to say, John Baker, Jacob Baker, Philip Baker, Peter Baker, & George Baker, I will & bequeath to each of them the one equal twelfth part of all my real & personal estate not otherwise disposed of by this my will, & also discharge them from a book account of $80.00 each that I gave to them. I further will and order that my executor of my personal estate after my demise shall sell all my personal property not otherwise disposed of by this my will & after my debts are paid & funeral charges paid & court charges the balance is to be paid to Wm Baker, my son, Hannah Baker, my daughter, to Polly Baker, now Polly Roof, my daughter & Jacob Roof, my son-in-law, and to my daughter Susannah Baker, now Susannah McMillen & my son-in-law Robert McMillen, to my daughter Julian Baker, now Julian Thatcher & my son-in-law Isaac Thatcher, the several sums specified in this my will, that is to say, to my son William, $80.00. To my daughter Hannah Baker, ninety dollars, to my daughter Polly Baker now Polly Roof, nine dollars 32 _ cents, to my daughter Julian Baker, now Julian Thatcher, $42.37 _, and to Susannah Baker now Susannah McMillen, my daughter, $36.80 cents. These several sums to be paid out of my personal estate & it will not pay all to pay an equal dividend & the same. I further will & order that in the case of either the death or marriage of dear wife Susannah Baker, in that case executor of my real estate shall sell the same according to law & give a credit of four years after first having one-fourth of the purchase money be paid in hand & the deed not to be until full payment is made my executer to pay the different heirs as I have directed. If my personal property is not sufficient to pay the same, this is to be paid out of the first payment of the land, & next to pay my son Wm Baker out of the first said payment on the land his share in the real estate & the balance to be equally divided among my heirs and the remaining payments to be equally divided as they become due & are received, to my said heirs that has not been paid after redirecting the proper fees & charges. I hereby order & direct that all gifts & grants that I heretofore give to any of my children that is not mentioned in this will shall never be brought against either or any of them either one against the other or others or my extensor. That lastly I constitute & appoint William Robison to be the sole executor of my personal estate as specified in this my will. I also hereby constitute & appoint my son-in-law, Isaac Thatcher, my sole executor of my real estate to do and prepare what is heretofore specified of this my last will & testament.
